We specialize in complete custom van builds, curated upgrade packages, and related services for off-road adventure vans and family weekender vehicles. These Terms of Service govern your use of our website at scallywagonadventurevans.com and your engagement with our services.

2. Website Use

Permitted use. Our website is provided for informational purposes and to facilitate inquiries about our services. You may browse, read, and use the website for personal, non-commercial purposes in accordance with these terms

Prohibited use. You agree not to use our website in any way that is unlawful, harmful, or disruptive. Specifically, you agree not to:

3. Services and Build Agreements

Service agreements. All van builds, upgrade installations, and other services provided by Scallywagon Adventure Vans are governed by a separate written service agreement entered into between Scallywagon and the client at the time of project commencement. These Terms of Service apply broadly to your relationship with Scallywagon and your use of our website. Your specific build or service project is governed by the terms of your individual service agreement.

Quotes and estimates. All quotes and estimates provided by Scallywagon Adventure Vans are based on the information available at the time of the consultation and are subject to change if the scope of work changes, if unforeseen conditions are discovered during the build, or if parts or material costs change materially between the time of the quote and the commencement of work. Any significant changes to scope or cost will be communicated to the client and agreed upon in writing before additional work proceeds.

Project timelines. Build timelines provided during the consultation process are estimates based on current scheduling and parts availability. Scallywagon Adventure Vans will make reasonable efforts to meet agreed timelines but is not liable for delays caused by parts availability, supply chain disruptions, circumstances beyond our control, or changes to project scope requested by the client.

Client responsibilities. Clients are responsible for providing accurate information about their vehicle at the time of consultation and build planning. Clients are responsible for ensuring their vehicle is in a condition suitable for the intended work when delivered to our shop. Clients are responsible for maintaining appropriate insurance on their vehicle throughout the build process.

Vehicle storage. Vehicles left at our shop beyond the agreed build completion date may be subject to storage fees at our discretion. We will notify clients in advance before any storage fees are applied.

4. Payments and Deposits

Deposit requirements. A deposit is required before work begins on any build or service project. The deposit amount will be specified in your individual service agreement. Deposits are non-refundable once materials have been ordered or work has commenced, except where Scallywagon Adventure Vans is unable to complete the agreed work for reasons within our control.

Payment schedule. Payment schedules for larger projects will be outlined in your individual service agreement. Payments are due as specified in that agreement. Scallywagon Adventure Vans reserves the right to pause work on a project if agreed payment milestones are not met.

Final payment. Final payment is due upon completion of the build or service and before the vehicle is released from our shop. We accept payment methods as specified at the time of your service agreement.

Returned payments. Any returned checks or failed electronic payments may be subject to a processing fee. Scallywagon Adventure Vans reserves the right to apply a late fee to outstanding balances not paid within the terms of the service agreement.

5. Warranties and Workmanship

Workmanship warranty. Scallywagon Adventure Vans stands behind the quality of our workmanship. Specific warranty terms for your build or service project will be outlined in your individual service agreement. Our workmanship warranty covers defects in the installation and fabrication work performed by our shop under normal use conditions.

Component warranties. Components and parts installed in your build are subject to the warranty terms of their respective manufacturers. Scallywagon Adventure Vans does not extend manufacturer warranties beyond their original terms but will assist clients in pursuing warranty claims with manufacturers where applicable.

Warranty exclusions. Warranties do not cover damage resulting from misuse, accidents, unauthorized modifications, off-road use beyond the reasonable capabilities of the installed components, normal wear and tear, or failure to maintain the vehicle and installed systems in accordance with manufacturer recommendations.

Warranty service. To make a warranty claim on workmanship, contact us at [email protected] or call 253-232-6837. We will assess the claim and respond in a timely manner. Warranty service requires the vehicle to be returned to our shop for inspection and repair.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Scallywagon Adventure Vans shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of our website, our services, or any van build or upgrade project, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or related to our services shall not exceed the total amount paid by you to Scallywagon Adventure Vans for the specific service giving rise to the claim.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

7. Off-Road and Adventure Use

Scallywagon Adventure Vans builds and upgrades vehicles intended for use in off-road and adventure travel conditions. Clients acknowledge that off-road travel involves inherent risks that are outside the control of Scallywagon Adventure Vans. By engaging our services for off-road or adventure van builds, you acknowledge and accept those inherent risks.

Scallywagon Adventure Vans is not liable for damage to the vehicle, its systems, or installed components resulting from off-road use, accidents, recovery situations, extreme conditions, or any use beyond the reasonable operating parameters of the installed components.

Clients are responsible for understanding the capabilities and limitations of their vehicle and installed systems and for operating their vehicle safely and within those parameters at all times.

8. Client-Supplied Materials and Vehicles

When clients supply their own vehicle, components, or materials for use in a build or service project, Scallywagon Adventure Vans is not responsible for pre-existing conditions, defects, or failures in those items. We will inspect client-supplied vehicles and materials to the best of our ability and communicate any concerns before proceeding with work, but we cannot be held responsible for issues that were not detectable at the time of inspection or that arise from the inherent condition of client-supplied items.

9. Dispute Resolution

Good faith resolution. Most concerns can be addressed quickly through direct communication.

Governing law. These Terms of Service and any disputes arising out of your relationship with Scallywagon Adventure Vans are governed by the laws of the State of Washington, without regard to its conflict of law provisions.

Jurisdiction. Any legal proceedings arising out of these terms or your relationship with Scallywagon Adventure Vans shall be brought in the appropriate courts of Pierce County, Washington.
